Terms & Conditions

Welcome to Bachata Brotherhood. These Terms & Conditions govern your use of the Bachata Brotherhood website, participation in Bachata Brotherhood programs, and purchase of services offered by Bachata Brotherhood.

By accessing this website, registering for a class, joining a team or program, purchasing a service, or otherwise participating in Bachata Brotherhood activities, you agree to these Terms.

For purposes of these Terms, “Bachata Brotherhood,” “we,” “us,” and “our” refer to Bachata Brotherhood, doing business as Bachata Brotherhood.

 

1. About Bachata Brotherhood

Bachata Brotherhood is a dance organization providing services that may include:

  • Dance instruction

  • Performance and training teams

  • Workshops and training sessions

  • Social events and community activities

  • Private lessons

  • Membership programs

  • Merchandise

Specific offerings, schedules, locations, instructors, pricing, requirements, and availability may change from time to time.

 

2. Eligibility

Participants must meet any age, experience, conduct, or other eligibility requirements stated for a particular program.

Participants under the age of 18 must have the permission of a parent or legal guardian and may be required to have a parent or legal guardian complete additional registration, consent, and liability documents.

Bachata Brotherhood reserves the right to determine eligibility for team programs, performance opportunities, leadership positions, and other selective programs.

 

3. Registration and Account Information

When registering for a Bachata Brotherhood service, you agree to provide accurate and current information.

You are responsible for ensuring that the contact information associated with your registration remains accurate so that we may provide important information regarding schedules, payments, events, cancellations, or program changes.

You are responsible for maintaining the confidentiality of any account credentials associated with the website.

 

4. Payments and Fees

Prices for classes, memberships, team programs, events, private lessons, merchandise, and other services will be disclosed before purchase.

By completing a purchase, you authorize Bachata Brotherhood or its payment processor to charge the payment method you provide for the amount disclosed at the time of purchase.

You are responsible for all agreed-upon fees associated with the program or service for which you register.

Failure to make required payments may result in suspension or termination of participation.

 

5. Recurring Payments and Automatic Renewal

A program will not automatically renew unless it is specifically identified as an automatic-renewal or recurring-payment program when you enroll.

If Bachata Brotherhood offers a recurring membership or subscription, the applicable price, billing frequency, renewal terms, minimum commitment, and cancellation procedures will be disclosed before enrollment.

Where required by law, Bachata Brotherhood will obtain your affirmative consent before initiating recurring charges.

Cancellation of an automatic-renewal program will stop future renewals but will not automatically entitle the participant to a refund for amounts already properly charged, except where required by law or otherwise stated in the applicable refund policy.

6. Cancellations, Refunds, and Credits

Cancellation and refund policies may differ depending on the program, class, event, membership, or service purchased.

Any specific cancellation or refund terms presented to you during registration or purchase will become part of your agreement with Bachata Brotherhood.

Unless otherwise expressly stated:

  • Payments already made are non-refundable except where required by law;

  • Missed classes, rehearsals, or events do not automatically qualify for refunds or credits;

  • Failure to attend or participate does not eliminate an outstanding payment obligation that was agreed to at registration; and

  • Credits, transfers, or exceptions may be granted at Bachata Brotherhood’s discretion.

If Bachata Brotherhood cancels a paid event or service entirely, we may provide an appropriate refund, credit, rescheduling option, or replacement service depending on the circumstances.

 

7. Schedule, Instructor, and Location Changes

Dance programs depend on studio availability, instructor availability, event schedules, venue requirements, and other circumstances.

Bachata Brotherhood reserves the right to modify:

  • Class or rehearsal times

  • Locations

  • Instructors

  • Performance dates

  • Team assignments

  • Program schedules

  • Other operational details

Reasonable efforts will be made to communicate significant changes to affected participants.

 

8. Team Membership

Acceptance onto a Bachata Brotherhood team does not guarantee a participant:

  • A specific performance

  • A particular position within choreography

  • A specific partner

  • Advancement in rank

  • Advancement in skill level

  • A leadership position

  • Continued participation for future terms

  • Selection for every event or opportunity

Team placement and performance decisions may consider factors including attendance, preparedness, conduct, teamwork, ability, consistency, choreography needs, and the needs of the organization.

 

9. Brotherhood Rankings and Titles

Bachata Brotherhood may use internal ranks, titles, awards, skill levels, honors, and leadership designations.

These may include ranks such as Squire, Knight, Noble, Royal, and Elder, as well as other titles or distinctions established by Bachata Brotherhood.

Ranks and titles are honorary organizational designations and do not create employment rights, ownership interests, financial interests, or legal authority within Bachata Brotherhood unless a separate written agreement expressly provides otherwise.

Bachata Brotherhood retains discretion regarding the criteria, awarding, recognition, suspension, or removal of organizational ranks and titles.

 

10. Code of Honor and Brotherhood Oath

Members and participants are expected to conduct themselves respectfully and professionally while participating in Bachata Brotherhood activities.

Participants may also be required to acknowledge or sign the Bachata Brotherhood Oath, Code of Conduct, or other membership standards as a condition of team membership.

Conduct that may result in discipline, suspension, or removal includes, but is not limited to:

  • Harassment or discrimination

  • Threatening, intimidating, or violent behavior

  • Sexual harassment or inappropriate conduct

  • Repeated disruption of classes or rehearsals

  • Deliberate damage to property

  • Theft

  • Serious disrespect toward instructors, members, venues, or event organizers

  • Conduct that creates an unreasonable safety risk

  • Repeated failure to satisfy team responsibilities

  • Conduct that materially damages the safety, operations, or legitimate interests of Bachata Brotherhood

Disciplinary decisions may depend on the severity and circumstances of the conduct involved.

Bachata Brotherhood reserves the right to suspend or terminate participation when reasonably necessary to protect participants, instructors, venues, the organization, or the integrity of its programs.

11. Physical Activity and Assumption of Risk

Dance is a physical activity.

Participation may involve risks including falls, collisions, muscle strains, sprains, physical contact with other dancers, and other injuries associated with dancing, exercise, rehearsals, performances, or participation at dance venues.

Participants are responsible for determining whether they are physically able to safely participate.

Bachata Brotherhood may require participants to execute a separate Release of Liability and Assumption of Risk Agreement before participating in certain activities.

Nothing in these Terms is intended to waive or limit rights or liabilities that cannot legally be waived under applicable law.

12. Personal Property

Participants are responsible for their own personal property at classes, rehearsals, events, performances, and venues.

To the fullest extent permitted by law, Bachata Brotherhood is not responsible for lost, stolen, misplaced, or damaged personal property unless caused by conduct for which liability cannot lawfully be excluded.

 

13. Photos, Videos, and Media

Bachata Brotherhood frequently operates in environments where photography and video recording may occur, including performances, classes, rehearsals, social events, and promotional activities.

Specific permission regarding the commercial or promotional use of a participant’s name, image, likeness, voice, photograph, or video may be governed by a separate Photo & Video Release or other consent agreement.

Where separate consent is required, participation in the website alone does not substitute for that consent.

14. Intellectual Property

The Bachata Brotherhood name, logos, designs, graphics, artwork, ranks, branded materials, website content, photographs, videos, written materials, and other original content are owned by or licensed to Bachata Brotherhood unless otherwise stated.

You may not reproduce, distribute, sell, modify, commercially exploit, or represent yourself as authorized to use Bachata Brotherhood branding without prior written permission.

Nothing in these Terms grants ownership of Bachata Brotherhood intellectual property to any participant or member.

 

15. Choreography and Training Materials

Choreography, instructional materials, videos, team training materials, internal documents, and other creative materials provided through Bachata Brotherhood may be protected by applicable intellectual-property rights.

Members may use materials provided to them for their intended training and participation purposes.

Commercial reproduction, resale, unauthorized distribution, or representation of proprietary Bachata Brotherhood materials as your own is prohibited unless permission has been granted.

 

16. Website Use

You agree not to:

  • Attempt to interfere with the operation or security of the website;

  • Use the website for unlawful activity;

  • Attempt unauthorized access to accounts, systems, or data;

  • Upload malicious software;

  • Impersonate Bachata Brotherhood or another person;

  • Use Bachata Brotherhood branding in a misleading manner; or

  • Copy or commercially exploit website content without authorization.

We may restrict access to the website when reasonably necessary to protect the website, its users, or Bachata Brotherhood.

 

17. Third-Party Services and Venues

Bachata Brotherhood may conduct activities at independently operated studios, restaurants, clubs, event venues, or other third-party locations.

We may also use third-party platforms for payments, registration, communication, social media, or scheduling.

Those third parties may maintain their own policies and terms.

Bachata Brotherhood does not control all actions, services, policies, or conditions of independent third parties.

18. Merchandise

Merchandise availability, sizes, designs, prices, and fulfillment times may vary.

Any merchandise-specific return, exchange, shipping, or refund policy presented at the time of purchase will govern that transaction.

19. No Guarantee of Results

Dance development varies between individuals.

Bachata Brotherhood does not guarantee that participation will result in any particular skill level, performance opportunity, ranking, competition result, employment opportunity, social outcome, or other specific result.

 

20. Suspension or Termination

Bachata Brotherhood may suspend or terminate a person's access to a program, team, event, website service, or membership for material violations of these Terms, applicable membership agreements, safety requirements, or the Brotherhood Code of Conduct.

Where appropriate, Bachata Brotherhood may consider warnings or other corrective measures before termination. Serious misconduct may result in immediate removal.

Termination does not automatically create a right to reimbursement for previously provided services or amounts otherwise non-refundable under the applicable purchase terms, except where required by law.

 

21. Limitation of Liability

To the fullest extent permitted by applicable law, Bachata Brotherhood and its owners, directors, instructors, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising solely from your use of the website or participation in services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Any separate liability waiver signed in connection with physical participation will be governed by its own terms.

 

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Bachata Brotherhood and its representatives from third-party claims, losses, or expenses resulting from your unlawful conduct, intentional misconduct, or material violation of these Terms.

This provision does not require you to indemnify Bachata Brotherhood for liability that cannot legally be transferred to you.

 

23. Privacy

Information collected through the Bachata Brotherhood website or registration process will be handled in accordance with the Bachata Brotherhood Privacy Policy.

The Privacy Policy is incorporated into these Terms by reference where applicable.

 

24. Electronic Communications

By providing an email address or telephone number, you agree that Bachata Brotherhood may contact you regarding your registration, account, payments, classes, rehearsals, performances, membership, safety notices, or other matters relating to services you have requested.

Marketing communications will be handled in accordance with applicable law and any opt-out rights provided to you.

25. Changes to These Terms

Bachata Brotherhood may update these Terms from time to time.

The revised Terms will display an updated effective date.

Material changes affecting an existing paid agreement will be handled in accordance with applicable law and any separate agreement governing that service.

Continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.

26. Governing Law

These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any dispute that is not subject to another valid written dispute-resolution agreement shall be brought in a court of competent jurisdiction in California, unless applicable law provides otherwise.

27. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

28. Entire Agreement

These Terms, together with any applicable registration agreement, membership agreement, liability waiver, Brotherhood Oath or Code of Conduct, Privacy Policy, payment terms, and other agreement expressly accepted by the participant, constitute the applicable agreement between the participant and Bachata Brotherhood regarding the relevant services.

If a program-specific written agreement conflicts with these general Terms, the program-specific agreement will control with respect to that program.
